“User” also refers to anyone who able to access the HELPERINFO website for any allowed purpose like uploading the helper information or writing the blogs in favor or against any Helper. This is acknowledged that user is liable to take prior consent from helper before uploading helper information & Helperinfo is not responsible incase user failed to take prior consent. Helper shall inform website customer care immediately if such wrong or incorrect or data without prior consent from helper is uploaded by any user in the website. HelperInfo Registration form is available at www.helperinfo.com. All users can download the registration form and Helpers shall enroll the form with all details with dully signed and thump stamp. All users must upload Helper Signed Registration Form while uploading the helper information.

“User” also refers to any Residential Welfare association authorized person or any authorized company official or any other third party who can upload the information for the Helper.

Content

"Content" will include (but is not limited to) images, identity proofs, address proofs, photos, audio, video, location data, nearby places, and all other forms of information or data. "Your content" or "User Content" means content that you upload images, any identity proofs, address proofs, photos, audio, video, user blogs, user share or transmit to, through or in connection with the Services, such as likes, ratings, reviews, images, photos, messages, profile information, Complaints and any other materials that you publicly display or displayed in your account profile and content published in other accounts as blogs, complaints, ratings or any other public data shared by you . "HELPERINFO content" means content that HELPERINFO creates and make available in connection with the Services including, but not limited to, visual interfaces, interactive features, graphics, design, compilation, computer code, products, software, aggregate ratings, reports and other usage-related data in connection with activities associated with your account and all other elements and components of the Services excluding Your Content and third party content. Helper

Helper definition in this terms and conditions refers to any skilled or unskilled person or company like security agency or resource consulting or services company or Self individual. This helper information shall be uploaded by Self individual or by the authorized Employer on behalf of their employees or by any authorized user or employee of Residential apartment association or by any other authorized third party which/whom is directly or indirectly known to the Helper.

Helper here refers to the any of the employee working under any legal organization or any domestic helper providing domestic services to any user or any individual are in business for providing any kind of services to any kind of user.

Helper also refers to the listing in this document which means the listing published by the users.

All must have dully signed Helperinfo Registration Form by respective Helper before uploading the user information in the www.helperinfo.com

Third Party

Any organization or any individual or any person which deals with Helperinfo for the data owned by helperinfo is refers to third party in this terms are conditions

III. CHANGES TO THE TERMS

HELPERINFO may vary or amend or change or update these Terms, from time to time entirely at its own discretion. You shall be responsible for checking these Terms from time to time and ensure continued compliance with these Terms. Your use of Site after any such amendment or change in the Terms shall be deemed as your express acceptance to such amended/changed terms and you also agree to be bound by such changed/amended Terms.

IV. ELIGIBILITY TO USE THE SERVICES

In creating an account and/or claiming your helper’ listing, you represent to us that all information provided to us in such process is true, accurate and correct, and that you will update your information as and when necessary in order to keep it accurate. If you are creating an account or claiming a helper listing, then you represent to us that you are the owner or authorized agent of such listing. You may not impersonate someone else, create or use an account for anyone other than yourself, provide an email address other than your own, create multiple accounts or helper listings except as otherwise authorized by us, or provide or use false information to obtain access to a helper’ listing on the Services that you are not legally entitled to claim. You acknowledge that any false claiming of a helper listing may cause HELPERINFO or third parties to incur substantial economic, pschyclogical or emotionally damages and losses for which you may be held liable and accountable and You will solely for responsible for any claim,action, dispute arising out of or in relation to such information and we Helperinfo website as well as PEOPAL Solutions Pvt. Ltd shall not be held liable for your information/actions.

You also agree that you will not allow any third party to use your account for the purpose of transacting activities in your name on the Services.

In order to provide a platform which will connect all the helpers/service providers across all the users through helperinfo website and also provide vital information about the helpers/service providers to Users. Helperinfo have provided this platform wherein the users of services can seek information about Helpers and also share their experiences and also recommend and share the services of any particular helper/service provider. The intention of HELPERINFO website is to provide the transparent environment and promote top rated helpers and also facilitate single platform access for various Helpers. That however in case anyone using the website provides any wrong information about Helpers and any action/claim/suit is filed by Helper , the User who shares such false information shall be solely responsible for the claim/action and any emotional, economical or any other consequential loss which is claimed by any person. That Both the Helpers and Users agrees and consents that they will not file any claim/action/loss against Helperinfo website or Peopal solutions private limited and will settle the dispute/action/claim amongst themselves without impeding Helperinfo website and Peopal Solutions private Ltd .

Any user who uploads the wrong information in helperinfo, and which may result in causing any harm, injury, loss to any person/individual/association of persons, will be solely liable for any loss or damages due to wrong information provided/uploaded and such person/individual/association of persons acknowledges that HELPERINFO is not liable directly or indirectly for any such consequences.

Any user who provides any kind of feedback or rating or complaints or any public information in favor or against any helper/provider on helperinfo website is liable to any kind of emotional losses or any psychologically losses or any economical losses as per legal laws of your country. Helperinfo is not accountable for any such incident or any such damages to any users or helper or any other who access helperinfo website. You acknowledge that HELPERINFO is not liable directly or indirectly for any such consequences.

Helperinfo is not into the business to collect the helpers or user information directly, However we are displaying in your website the information collected or shared by third parties, users, individual helpers, Organizations, Residential welfare associations or any other source of collecting the information. Helperinfo shall upload the information if shared by any of above source & Helperinfo is not liable or responsible or liable for any wrong information shared to us by any source.

You acknowledge that Helperinfo is not bound to provide any evidence or any personal or other information regarding any one under any dispute incur with any Helper or any user. All Helperinfo users must settle the disputes , if any, amongst themselves, without hampering or damaging the Helperinfo & Helperinfo is not bound to act as main party or third party for such disputes and shall not be involved dragged in any disputes.

You acknowledge that Helperinfo will own the data uploaded or published by any user. However user who uploads the information is solely liable/responsible for the correctness and authenticity of data publish/shared in the helperinfo.

You acknowledge that Helperinfo shall publish complete information or partial information to all the website visitors. Helperinfo is the having sole rights to publish complete or partial information to all website users/visitors.

You acknowledge that Helperinfo is the having the sole rights to publish complete or partial information to some preferred group of users which shall be same or vary for other website user/visitors.

You acknowledge that helperinfo can allow other users to link the helper uploaded by you. All other users shall notify or communicate with their linked helpers for any review or complaint or any rating etc.

You acknowledge that helperinfo will use the information & data uploaded by you for future purpose after you remove it completely from your user login credentials. This data will be stored for other linked or non linked users.

In order to connect you to certain helper listing, we provided value added telephony services through our phone lines, which connect directly to any helper phone lines. We record all information regarding this call including the voice recording of the conversation between you, the customer and the helper (for internal billing tracking purposes and customer service improvement at the helperinfo end). If you do not wish that your information be recorded in such a manner, please do not use the telephone services provided by HELPERINFO. You explicitly agree and permit HELPERINFO to record all this information when you dial HELPERINFO's phone numbers.

You agree to use the Services only for purposes that are permitted by (a) the Terms and (b) any applicable law, regulation or generally accepted practices or guidelines in the relevant jurisdictions.

Third party

You agree not to access (or attempt to access) any of the Services by any means other than the interface that is provided by HELPERINFO, unless you have been specifically allowed to do so, by way of a separate agreement with HELPERINFO. You specifically agree not to access (or attempt to access) any of the Services through any automated means (including use of scripts or web crawlers) and shall ensure that you comply with the instructions set out in any robots.txt file present on the Services.

You agree that you will not engage in any activity that interferes with or disrupts the Services (or the servers and networks which are connected to the Services). You shall not delete or revise any material or information posted by any other User(s), shall not engage in spamming, including but not limited to any form of emailing, posting or messaging that is unsolicited.

You agree not to have any objection against linking of you uploaded helper information to any other user. All user shall link the helper which is directly or indirectly associated with any user.

Your License to HELPERINFO Content:

We grant you a personal, limited, non-exclusive and non-transferable license to access and use the Services only as expressly permitted in these Terms. You shall not use the Services for any illegal purpose or in any manner inconsistent with these Terms. You may use information made available through the Services solely for your personal, non-commercial use. You grant us the right to use the name or username that you submit in connection with Your Content. Representations Regarding Your or User Content:

You are responsible for Your Content. If Your Content is a review, you represent and warrant that you are the sole author of that review and shall be solely responsible/accountable for any action, claim, dispute which arises out of such post/review; the review reflects an actual helper experience that you had; and Helper can also share about his experience as if he/they were not paid or otherwise remunerated in connection with your authoring or posting of the review; and User/helper had no financial, competitive, or other personal incentive to author or post a review that was not a fair expression of User/Helper honest opinion.

You assume all risks associated with Your Content, including anyone's reliance on its quality, accuracy, or reliability, or any disclosure by you of information in Your Content that makes you personally identifiable. While we reserve the right to remove content, we do not control actions or content posted by our users and do not guarantee the accuracy, integrity or quality of any content. You acknowledge and agree that content posted by users and any and all liability arising from such content is the sole responsibility of the user who posted the content, and PEOPAL Solutions Pvt. Ltd shall remain absolved from any action, claim, suit or dispute in relation to posting of contents.

Content Removal.

We reserve the right, at any time and without prior notice, to remove, block, or disable access to any content that we, for any reason or no reason, consider to be objectionable, in violation of the Terms or otherwise harmful to the Services or our users in our sole discretion. Subject to the requirements of applicable law, we are not obligated to return any of Your Content to you under any circumstances.Any review, which is derogatory, defamatory or hateful and without any substantial evidence may be taken down at our sole discretion.

User Reviews & complaints

User reviews & complaints do not reflect the opinion of HELPERINFO. HELPERINFO receives multiple reviews or complaints by users, which reflect the opinions of the Users. It is pertinent to state that each and every review or complaint posted on HELPERINFO is the personal opinion of the user/reviewer only. HELPERINFO is a neutral platform, which solely provides a means of communication between users/reviewers including users or helpers/representatives with access to helper listing. The advertisements on HELPERINFO are published on an independent basis and there is no relation between the reviews of advertisers those who have advertised on the Services. We are a neutral platform and we don’t arbitrate disputes, however in case if someone writes a review/complaint that isn’t true about the helper, the best option for the helper himself would be to contact the reviewer/ complainer or post a public response in order to clear up any misunderstandings. If the helper believes that any particular user’s review violates HELPERINFO’s Policy, he can flag the review to our attention. HELPERINFO may remove the review in its sole discretion if review is in violation of the Terms, or content guidelines and policies or otherwise harmful to the Services.

5. Violates any third-party right, including, but not limited to, right of privacy, right of publicity, copyright, trademark, patent, trade secret, or any other intellectual property or proprietary rights;
6. Accuses others of illegal activity, or describes physical confrontations;

28. Attempts to do any of the foregoing.

You acknowledge that we have no obligation to monitor your – or anyone else’s – access to or use of the Services for violations of the Terms, or to review or edit any content. Further, if you are found to be in non-compliance with the laws and regulations, these terms, or the privacy policy of the Site, HELPERINFO shall have the right to immediately block your access and usage of the Site and HELPERINFO shall have the right to remove any non-compliant content and or comment forthwith, uploaded by you and shall further have the right to take appropriate recourse to such remedies as would be available to it under various statutes.

IN NO EVENT SHALL THE HELPERINFO PARTIES BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, EXEMPLARY OR CONSEQUENTIAL DAMAGES WHATSOEVER, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, INCLUDING BUT NOT LIMITED TO, ANY LOSS OF PROFIT (WHETHER INCURRED DIRECTLY OR INDIRECTLY), ANY LOSS OF GOODWILL OR BUSINESS REPUTATION, ANY LOSS OF DATA SUFFERED, COST OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES, OR OTHER INTANGIBLE LOSS.

FURTHERMORE, THE TOTAL LIABILITY OF THE HELPERINFO PARTIES TO YOU FOR ANY CAUSE OF ACTION YOU TAKE AGAINST THE HELPERINFO PARTIES WILL AT ALL TIMES BE LIMITED TO ONE HUNDRED INR (INR100.00) OR THE AMOUNT YOU HAVE PAID TO US IN THE LAST TWELVE (12) MONTHS, IF ANY, WHICHEVER IS GREATER.

Some countries and jurisdictions do not allow the limitation or exclusion of consequential, direct, indirect, or other damages and to the extent you are a consumer the limitations or exclusions in this section may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless the HELPERINFO Parties/ PEOPAL Solutions Pvt. Ltd from and against any third party claims, damages (actual and/or consequential), actions, proceedings, demands, losses, liabilities, costs and expenses (including reasonable legal fees) suffered or reasonably incurred by us arising as a result of, or in connection with: (i) Your Content, (ii) your unauthorized use of the Services, or products or services included or advertised in the Services; (iii) your access to and use of the Services; (iv) your violation of any rights of another party; or (v) your breach of these Terms, including, but not limited to, any infringement by you of the copyright or intellectual property rights of any third party. We retain the exclusive right to settle, compromise and pay, without your prior consent, any and all claims or causes of action which are brought against us. We reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us and you agree to cooperate with our defense of these claims. You agree not to settle any matter in which we are named as a defendant and/or for which you have indemnity obligations without our prior written consent. We will use reasonable efforts to notify you of any such claim, action or proceeding upon becoming aware of it.

Partnership or Agency: None of the provisions of these Terms shall be deemed to constitute a partnership or agency between you and HELPERINFO and you shall have no authority to bind HELPERINFO /PEOPAL Solutions Pvt. Ltd in any form or manner, whatsoever.

Governing Law/Waiver:

For Users residing in the India: These Terms shall be governed in all respects by the laws India constitution as they apply to agreements entered into and to be performed entirely within the Indian laws between India residents, without regard to conflict of law provisions. You agree that any claim or dispute you may have against HELPERINFO must be resolved exclusively by a Karnataka state & Bangalore jurisdiction. You agree to submit to the personal jurisdiction of the courts located within Bangalore, Karnataka for the purpose of litigating all Claims that arise between You and HELPERINFO.

For all Users: YOU MUST COMMENCE ANY LEGAL ACTION AGAINST US WITHIN ONE (1) YEAR AFTER THE ALLEGED HARM INITIALLY OCCURS. FAILURE TO COMMENCE THE ACTION WITHIN THAT PERIOD SHALL FOREVER BAR ANY CLAIMS OR CAUSES OF ACTION REGARDING THE SAME FACTS OR OCCURRENCE, NOTWITHSTANDING ANY STATUTE OF LIMITATIONS OR OTHER LAW TO THE CONTRARY. WITHIN THIS PERIOD, ANY FAILURE BY US TO ENFORCE OR EXERCISE ANY PROVISION OF THESE TERMS OR ANY RELATED RIGHT SHALL NOT CONSTITUTE A WAIVER OF THAT RIGHT OR PROVISION.

Carrier Rates may Apply: By accessing the Services through a mobile or other device, you may be subject to charges by your Internet or mobile service provider, so check with them first if you are not sure, as you will be responsible for any such costs.

Linking and Framing: You may not frame the Services. You may link to the Services, provided that you acknowledge and agree that you will not link the Services to any website containing any inappropriate, profane, defamatory, infringing, obscene, indecent, or unlawful topic, name, material, or information or that violates any intellectual property, proprietary, privacy, or publicity rights.
